Terms
1. All contracts between Granito London Limited (‘Granito’) whose registered office is situate at 247 Field End Road Eastcote Middlesex HA4 9NJ and the person firm or company who accepts the quotation (the ‘Customer’) for the supply and installation of the goods shall be governed by these terms and conditions. No variation or addition shall be binding unless agreed in writing.
2. It is the responsibility of the Customer to ensure that the specifications put in the order correctly reflects their requirements.
3. A quotation by Granito does not constitute an offer and Granito reserves the right to withdraw or amend the same at any time prior to Granito’s acceptance of the Customers order.
4. The quality quantity and specification of the order shall be as set out in the quote (subject to any necessary adjustment on inspection/templating subject always to the following:
(a) All natural materials supplied such as granite and stone are subject to their natural markings
veinings variations in colour and tone cracks and vents and in the case of quartz any markings
and variation in colour and tone (so long as they are within the manufacturers tolerance).
(b) When samples have been provided identical resemblance of the product supplied to the
sample cannot be guaranteed.
(c) Any descriptions of material offered are for guidance only and do not imply suitability for any
particular purpose.
(d) All thicknesses quoted are nominal and no liability is accepted for reasonable variations of
whatsoever nature.
(e) The cut of the material will be in the absolute discretion of Granito
(f) in respect of glass splash backs given the nature of the product any gaps between the glass and surface to which it
abuts shall be within an acceptable tolerance
Any alterations the Customer makes after templates have been made may be subject to an extra charge.
5. The quote supplied is based on measurements/drawings supplied by the Customer. If on templating/inspection the measurements are greater the price may vary. Granito will inform the Customer of any variation in price as soon as possible after templating/inspection and will not commence the order/fabrication of the goods until the Customers agreement has been obtained . Payment of the deposit will confirm the Customers agreement to any variation in the price.
6. The Customer will ensure that all surfaces are clear and any temporary surfaces removed to enable the tops to be accurately templated. Failure to so do may result in a call out fee of £75.00 plus VAT.
7. Customers shall pay a 50% non refundable deposit upon templating or in the case of supply only the order of the goods. Upon receipt of cleared funds for the deposit the order and/or fabrication of the goods will commence. The balance is payable immediately upon completion of the installation or collection/receipt of the goods.
Granito reserves the right to charge interest on any late payment at a rate of 5% above base rate of Barclays Bank Plc for the period (whether before or after any judgement).
9. Method of payment can be by Bank Transfer Cheque Debit Card or Credit Card
10. In the case of worktops it is usual for installation (delivery of goods) to take place between 7 – 10 working days from templating or the receipt of cleared funds for the deposit which ever shall be the latter. In the case of glass splash backs the period is generally between 20 – 30 working days. Any dates quoted for delivery of goods are approximate only and Granito shall not be liable for any delay in the delivery of goods howsoever caused. Granito will endeavour to fulfil its agreed commitments to its Customers. Time shall not be of the essence in the contract unless expressly agreed by Granito in writing.
Notwithstanding the property (title) to the goods shall not pass to the Customer until Granito has received full payment for the goods. Until such time as the property in the goods pass to the Customer Granito shall be entitled at any time to require the Customer to deliver up the goods (in the same condition as they were in on installation/delivery) to Granito and if the Customer fails to do so forthwith to enter upon any premises with or without any third party and repossess the goods.
11. Risk of damage to or loss of the goods shall pass to the Customer at the time of delivery/installation. Granito shall be under no liability in respect of any defect in the goods arising from design specification or template supplied by the Customer or on behalf of the Customer by a third party or defect arising from wear and tear wilful damage negligence failure to follow Granito’s instructions (whether oral or in writing) misuse, or alteration or repair of the goods by a party not authorised Granito..
12 . Gaps behind the work surface or between the top of the upstand and the wall will be left unfilled to allow for decoration by others.
